• Rule 23(c)(4) – when appropriate an action may be brought or maintained as a class action with respect to particular issues.
• Allows Plaintiffs to circumvent the predominance requirement of 23(b)(3).
  – Are specific issues common to and typical of class.

• District Court cannot manufacture predominance through the nimble use of (c)(4).
• Must satisfy predominance requirement and that (c)(4) is a housekeeping rule that allows courts to sever common issues for a class trial.
• Court also expressed concerns that bifurcation of issues would run afoul of 7th Amendment.

• “Even if the common questions do not predominate over the individual questions so that class certification of the entire action.
• Rule 23 authorizes Court in appropriate cases to isolate the common issues under Rule 23(C)(4) and proceed with class treatment of these particular issues.
• Does issue certification advance the litigation?
  – That is make it more manageable.
• The Supreme Court has not yet ruled on whether issue certification should be applied as stringently as the Rule 23(b)(3) predominance requirement.
• 2nd, 4th, 6th, 7th and 9th circuits have adopted a laxer view.
