  • PFAS litigation began about two decades ago with environmental tort claims, mostly against manufacturers of PFAS and PFAS-containing materials.
  • Litigation has expanded to companies down the supply chain, including against processors of PFAS-containing materials, manufacturers of firefighting foam, and others.
  • There has been a developing trend of consumer fraud class actions against manufacturers and retailers of consumer products. In these cases, plaintiffs typically allege the presence of PFAS in the products and assert claims based on allegedly misleading advertising and violations of state consumer protection laws.
