The Evidence Lawyers Should Look For
Construction delay claims are rarely won by the party with the most dramatic narrative. They are won by the party that can connect a specific event to a measurable impact on the project’s critical path, supported by contemporaneous records and a disciplined damages analysis.
For counsel, the central task is not merely proving that work finished late. It is establishing liability, causation, and resulting harm—while anticipating the opposing party’s arguments regarding concurrent delay, inadequate mitigation, defective scheduling, and unsupported damages.
Start With the Contractual Framework
Before reviewing schedules or interviewing witnesses, counsel should identify the contract provisions governing time. Notice requirements, time-extension clauses, differing-site-condition provisions, suspension rights, liquidated damages, force majeure, and changes clauses may determine whether an otherwise persuasive delay theory is contractually viable.
The relevant question is not simply, “Who caused the delay?” It is also:
- Was the event one for which the contract allocated risk?
- Was timely notice required?
- Did the claimant preserve entitlement to an extension?
- Does the contract require a particular schedule-analysis method?
- Are delay damages barred, limited, or subject to a waiver?
A strong factual case can fail if the contractual gateway was never satisfied.
Build the Evidentiary Timeline
The most valuable evidence is often created before litigation begins. Lawyers should collect and organize:
- The baseline schedule and every accepted update.
- Logic reports, activity lists, and schedule narratives.
- Daily reports, superintendent logs, inspection records, and photographs.
- Requests for information, submittals, transmittals, and approval histories.
- Change orders, directives, meeting minutes, and correspondence.
- Procurement records, delivery tickets, payroll data, and equipment logs.
- Weather records and site-access documentation.
- Notices of delay, reservation-of-rights letters, and time-extension requests.
These materials should be mapped onto a unified chronology. The objective is to identify when the event occurred, what work it affected, whether the affected activities were critical at that time, and how the project responded.
A schedule is not self-proving. Its conclusions must be anchored in the underlying project record. Industry guidance similarly emphasizes that forensic schedule analysis should reflect contemporaneous documents, data, and witness testimony rather than merely recreate a preferred litigation theory.
Test the Critical Path
A delay to a noncritical activity may consume float without delaying project completion. Conversely, an activity that was critical at the start of the project may no longer have been critical when the alleged delay occurred.
That is why counsel should be cautious about accepting a simple “planned versus actual” comparison. A credible analysis should examine the schedule dynamically, account for logic changes and resequencing, and identify the longest path during the relevant period. Common approaches include as-planned versus as-built, windows analysis, time impact analysis, and collapsed as-built analysis.
The proper method depends on the quality of the schedules, the timing of the claim, the availability of contemporaneous updates, and the nature of the alleged event. Method selection should be explained—not treated as a technical detail delegated entirely to the expert.
Investigate Concurrent Delay and Mitigation
Defendants should look for evidence that the contractor was already late, failed to mobilize adequate resources, performed defective work, delayed procurement, or failed to mitigate the claimed impact. Plaintiffs, meanwhile, should preserve evidence showing reasonable efforts to resequence work, obtain substitute materials, add labor, or accelerate performance.
Concurrent delay is not established by pointing to multiple problems on a project. The analysis must determine whether independent delaying events affected the critical path during the same period and whether the contract or governing law assigns consequences to that overlap.
Prove Damages Separately
Time entitlement and monetary recovery are related but distinct. Counsel should connect claimed extended overhead, supervision, equipment, labor inefficiency, financing costs, and subcontractor damages to the proven delay period.
A global damages claim with weak allocation is vulnerable, particularly where records permit a more precise calculation. The better approach is to tie each cost category to accounting records, approved schedules, labor and equipment data, and a clearly defined causation period.
The Strategic Advantage
Thoughtful delay advocacy treats the claim as a reconstruction of project decision-making. The strongest case does not merely show that an event occurred. It demonstrates what the project team knew, when it knew it, how the event changed the critical path, what responses were available, and why the resulting time and cost consequences were reasonable.
In construction litigation, contemporaneous evidence is not background material. It is the architecture of credibility.
